GENERAL TERMS AND CONDITIONS OF BUSINESS

1. RESERVATION (BOOKING)

When reserving (booking) your stay, a deposit of 30% of the total rental price (including the additional services you have booked) must be transferred to one of our accounts specified in the rental agreement.

After receipt of your payments, you will receive a corresponding confirmation (usually by e-mail or fax).

The remaining 70% of the total rental price (including the additional services you have booked and the deposit) must be transferred to the bank account specified by us 14 days before the day of arrival.

If you have not transferred the full remaining total rental price despite the notification letter, you can pay it on the day of arrival. Otherwise the keys cannot be handed over to you at the holiday destination.

We don't accept checks! If you pay by credit card, we will charge you a fee of 0.5% of the payment amount.

The customer is responsible for taking out travel cancellation insurance. We expressly advise you to take out travel cancellation insurance.

2. RENTAL PERIOD / DATES / OPENING HOURS

The rental period is specified in the main part of the contract.

Keys are handed over between 4:00 p.m. and 6:00 p.m. in our office.

In the event that the tenant cannot appear at the office at the given time, he must contact LEON and communicate the arrival time so that LEON can organize the handover of the keys. The Leon company is free from any obligation and the customer loses his deposit and any claims in case of no-show.

The rental property must be vacated by no later than 10 a.m. on the day of departure, and the exact time for inspection of the property must be agreed with LEON no later than 48 hours before departure. The tenant must be present when the property is handed over.

In the case of urgent repairs, the Leon company must be informed.

The opening hours of our office are: Monday – Friday: 9.30 a.m. to 7.00 p.m Saturday : 10am to 6pm

3. PRIZES

Accommodation/Occupancy

Our prices include all taxes. They include the provision of the accommodation, the reported additional costs and the booked additional services.

However, they do not include the visitor's tax that may have to be paid on site, as well as the insurance premiums for the insurance companies.

We draw your attention to the fact that accommodation booked for a certain number of people may under no circumstances be occupied by more people than stated in the booking.

Our terraces and gardens are not all equipped with tables and chairs.

Additional services

Our accommodation prices, as well as additional services, are shown on our website and our catalogue, as well as on site.

4. CHANGE / CANCELLATION OF BOOKING BY CUSTOMER

Change/Accommodation

We endeavor to accommodate your change requests regarding the dates of your stay, the accommodation and the holiday location as best as possible, subject to availability. If the booking amount (excluding optional additional services) is lower than the previous booking amount after the booking has been changed, we reserve the right to withhold a change fee of €50.

Change/Optional additional services

We endeavor to accommodate your change requests regarding the booked optional additional services as best as possible, subject to availability. If, after making the change, the amount for the optional additional services is less than the previous amount, we reserve the right to withhold a change fee of €30.

Cancellation

Cancellations must be communicated to us in writing, whereby the date of receipt of your cancellation applies to us as the cancellation date.

Cancellation/Accommodation

In principle, the deposit of 30% will be retained in the event of cancellation. We therefore expressly point out once again that you should take out travel cancellation insurance.

We charge for cancellations up to and including the 90th day before the arrival date 25% of the total rental price. (The difference to the deposit paid will be refunded to you).

For cancellations between the 89th and 60th day before the arrival date, we will charge you 50% of the total rental price.

For cancellations between the 59th and 30th day before the arrival date, we will charge you 75% of the total rental price.

For cancellations less than 29 days before the date of arrival, we will charge you the complete remaining total rental price (the deposit already paid is deducted from this).

This remaining total rental price is to be transferred to one of our accounts named in the rental agreement within 10 days.

No-show at the place of stay

If you do not show up at the place of stay, we will charge you the complete remaining total rental price (the deposit already paid is deducted from this).

Optional additional services

Failure to use booked and invoiced optional additional services at the holiday destination does not give rise to any entitlement to a reimbursement of costs, unless you were unable to do so for certain reasons, such as in cases of force majeure, illness or accident, which you have informed us of in writing would have to certify.

5. DEPOSIT DEPOSIT

Upon arrival and handover of the keys, a deposit is required for each holiday home, in the amount shown in the rental agreement.

After acceptance and inspection of your rental property by our staff at the time of your departure with return of the key, this deposit will be refunded to you in cash if necessary, or transferred back to you by bank transfer in the following days (we ask you to provide us with your bank details with IBAN and SWIFT when handing over the keys ). Any damage caused by you or services not yet paid for can be offset against this deposit.

6. PETS

Pets are allowed in most of our holiday accommodations for an additional fee (see our price list for the respective objects) on presentation of a vaccination card with valid rabies protection. Pets are allowed on a leash in the communal areas of the holiday complex, but generally not around and in the swimming pool.

7. HOUSE RULES

To make your everyday holiday easier, you will be informed of the rules that apply locally in the facility by means of a notice in your accommodation. Please note these rules and follow them. Some of the recommended precautions will help protect you from potential harm. For example, before leaving your holiday home, you should make sure that all doors and windows are locked.

We would like to point out that we assume no liability for items forgotten by you when you return your holiday home.

8. STAYS ABROAD

For booked trips or stays abroad, each traveler must have a valid identity card or passport. We also recommend that you check the validity of the identity card or passport of all those traveling with you (adults, children, babies) and your insurance policies and find out about the vaccination regulations and currency regulations applicable in the respective country.

We assume no landlord liability

9. TERMINATION OF STAY

In the event of early departure or the termination of booked accommodation and services with us, no claims for reimbursement can be asserted with us.

10. POSSIBLE MODIFICATIONS TO THE OFFERING OF SERVICES

If circumstances beyond our control (e.g. cases of force majeure) make it necessary to partially or completely change our range of services (complete or partial closure of a holiday home or a shared facility such as the swimming pool, etc.), no claims can be made be asserted against us for reimbursement.

11. CUSTOMER SERVICE

Our on-site teams are at your disposal during your stay to resolve any issues or complaints you may have, in order to take appropriate action to allow you to fully enjoy your stay with us.

12. ACKNOWLEDGMENT OF TERMS AND CONDITIONS

With the conclusion of a rental contract for one of our holiday properties, you automatically accept our General Terms and Conditions. We only publish a few descriptions and photos of holiday properties on our website for the purpose of pure orientation for the customer. Due to the variety of our offer, however, differences in the decorative equipment and the layout of the apartment are possible between the individual accommodations. For more precise information on the respective holiday rental property, please contact our reservations department. We would also like to point out that we will try to accommodate special requests regarding the location or orientation of the accommodation, but cannot guarantee this. All information on sports and leisure activities at the holiday home and from providers in the vicinity are given to us by the tourist offices and are non-binding information. We assume no liability in cases where there are no longer any sports or leisure activities available at the time of your stay. Since the offers on our website are published well in advance, you should inquire before booking whether there have been changes in the meantime with regard to the opening hours, the equipment of the holiday property or the additional services offered in your holiday property, which are a decisive criterion for you when choosing them accommodation are.

13. LIABILITY – STATUTE OF LIMITATIONS

We would like to point out that the liability provisions applicable in the hotel industry do not apply to landlords of holiday apartments and holiday homes. Accordingly, we are not liable in cases of theft, loss or damage to guests' personal belongings in the holiday facilities, including their accommodation, parking lots, common areas (such as bicycle and other storage rooms, etc.).

The statute of limitations for SC22 EMPURIABRAVA S.L. Amounts owed do not fall within the scope of the provisions applicable to the hotel industry.

Our general terms and conditions correspond to the provisions of the Spanish regulations of the Tourist Board.

14. Disclaimer

Leon is not liable for theft, loss or damage incurred or caused to the tenant during his stay. Interruption of the water and / or electricity supply by the municipal utility.

In the event of defective electrical appliances, the tenant must notify Leon of this. This will inform the technical customer service, which will normally repair the damage within 24 hours.

The tenant will be informed of construction sites in the municipality or in the vicinity of the rental property, provided that Leon is aware of them. Under no circumstances can the company be held responsible for this work and in no way obliged to pay any compensation.
